XXII. Provisions Other than GATS: A. Local Presence

Chile/Mexico
Chapter 10, Article 10-06: Local Presence
Neither Party will require a service provider from the other Party to establish or maintain a representative office or other type of enterprise, or to reside in its territory, as a condition for the cross-border provision of a service.

Chile/Canada
Chapter H, Article H-05. Local Presence
Neither Party will require a service provider from the other Party to establish or maintain a representative office or any form of enterprise, or to be resident in its territory, as a condition for the cross-border provision of a service.

Mexico/Nicaragua
Chapter X, Article 10-05: Local Presence
Neither Party will require a service provider from the other Party to establish or maintain a representative office or other type of enterprise, or to reside in its territory, as a condition for the provision of a service.

Mexico/Bolivia
Chapter IX, Article 9-05
Neither Party will require a service provider from the other Party to establish or maintain a representative office or other type of local firm, or to reside in its territory, as a condition for the provision of a service.

In addition, the Mexico/Bolivia Agreement specifies the following: Without prejudice to the above paragraph, any service provider who wishes to establish himself in the territory of the other Party, must fulfill the legal requirements of that Party.

Mexico/Costa Rica
Chapter IX, Article 9-05
Neither Party will require a service provider from the other Party to establish or maintain a representative office or other type of local firm, or to reside in its territory, as a condition for the provision of a service.

In addition, the Mexico/Bolivia Agreement specifies the following: Without prejudice to the above paragraph, any service provider who wishes to establish himself in the territory of the other Party, must fulfill the legal requirements of that Party.
